State and local police departments give high priority to arrests for driving under the influence (DUI). A high arrest rate earns the kind of publicity that government officials can brag about.
In the most recent year for which statistics are available, Nevada County made one DUI arrest for every 200 drivers who reside in the county. That statistic is exactly the same as the statewide average.
About a quarter of Nevada County DUI arrests occur in Truckee. That city has a lower arrest rate than California cities of comparable size. Law enforcement agencies in Grass Valley and other communities are more aggressive about making DUI arrests in Nevada County.

In the most recent year for which statistics are available, 426 drivers in Nevada County were arrested for DUI. Nearly all of those arrests were for misdemeanors. Eleven arrests were for felonies, probably because the driver was involved in a serious accident or had more than three recent DUI convictions. One arrest was for a juvenile DUI offense.
The 426 arrests represented a 19% increase in arrests over the previous year. A substantial increase usually represents a push to satisfy the demand of local politicians for a more visible DUI enforcement program. Unfortunately, when the police feel pressure to make more DUI arrests, innocent drivers suffer.
DUI Conviction Statistics in Truckee, Nevada County
A DUI arrest does not automatically lead to a conviction. People who believe there is no defense to a DUI charge are often surprised to learn that many cases are resolved without a DUI conviction.
In the most recent year for which statistics are available, about 85% of Nevada County DUI arrests resulted in a DUI conviction. Many of the arrested drivers decided to plead guilty without the benefit of legal representation.
About 5.5% of Nevada County DUI arrests were resolved with a conviction for some other offense. A majority of those dispositions involved a conviction for “wet reckless,” or reckless driving after consuming alcohol. The penalties for a “wet reckless” conviction are normally less harsh than DUI penalties.
More than 9% of arrested drivers avoided any conviction. In many of those cases, a lawyer successfully argued that the arresting officer made an unlawful traffic stop or arrested the driver without probable cause. In other cases, a judge or jury may have been persuaded that the evidence did not prove guilt.
